Instant Garden Terms of Service

Welcome to Instant Garden, a game by Bountiful Games, LLC (“Bountiful,” “we,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Instant Garden (the “Game”), our mobile application, and any related websites, content, and other services Bountiful may provide (collectively, the “Services”).

1. AGREEMENT TO TERMS

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms and/or the Privacy Policy, or if you do not meet the eligibility requirements in Section 2 below, you cannot access or use the Services.

If you are a minor under the laws of your jurisdiction, you must have your parent or legal guardian read and agree to these Terms on your behalf. You represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. ELIGIBILITY

You may use the Services only if you meet the following requirements and represent and warrant that you do so:

• You are 18 years of age or older and have the legal capacity to enter into a binding contract; or

• You are under the age of 18, in which case your parent or legal guardian must have reviewed and agreed to these Terms on your behalf.

We may refuse to offer the Services to any person or entity and change our eligibility criteria at any time.

3. PRIVACY POLICY

Please review our Privacy Policy, which also governs your use of the Services, for information on how we collect, use, and share your information. The Privacy Policy is incorporated by reference into these Terms.

4. CHANGES TO TERMS OR SERVICES

We may modify these Terms at any time, in our sole discretion. If we do so, we’ll let you know either by posting the modified Terms within the Game or through other communications. It’s important that you review the Terms whenever we modify them because if you continue to use the Services after we have posted modified Terms, you are indicating to us that you agree to be bound by the modified Terms.

5. LICENSE TO USE THE SERVICES

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the Game application on a mobile device that you own or control and to run such copy of the application solely for your own personal, non-commercial purposes.

6. USER ACCOUNTS

You are responsible for all activities that occur under your account, whether or not you know about them. You are responsible for safeguarding your account, and you should not share your account credentials with anyone. You must notify us immediately if you become aware of any breach of security or unauthorized use of your account.

7. SOCIAL FEATURES and IN-GAME COMMUNICATIONS

The Services include optional social features such as in-game chat, player profiles, friend lists, garden visits, gifting, referrals, and social actions (including helping, protecting, and stealing). When you use these features, certain information—such as your username, avatar, and gameplay actions—may be visible to other players.

You understand and agree that chat messages and other in-game communications may be monitored or reviewed by Bountiful for moderation, safety, fraud prevention, and enforcement of these Terms. You should not share personal or sensitive information in chat or through any social features.

8. IN-APP PURCHASES AND VIRTUAL ITEMS

The Services may include the option to purchase with real money a license to use virtual, in-game items, including but not limited to virtual currency ("Virtual Items"). You do not own the Virtual Items. You are granted a limited license to use them within the Services. We have the absolute right to manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice, and we will have no liability to you or any third party for any such actions.

All purchases of Virtual Items are final and non-refundable, except as required by applicable law.

9. PROHIBITED CONDUCT

You agree not to do any of the following:

• Use, support, or develop cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Services.

• Use the Services for any commercial purpose or for the benefit of any third party.

• Harass, threaten, bully, embarrass, or do anything else to another player that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, or heritage.

• Post, upload, or distribute any content that is unlawful, defamatory, libelous, or that a reasonable person could deem to be objectionable, offensive, or indecent.

• Disrupt, interfere with, or otherwise adversely affect the normal flow of the Services or otherwise act in a manner that may negatively affect other users’ experience.

• Attempt to gain unauthorized access to the Services, other players' accounts, or to the computers, servers, or networks connected to the Services.

• Use in-game chat or social features to harass, impersonate, deceive, threaten, or abuse other players.

• Share personal information (your own or others') through in-game chat or social features.

• Spam, advertise, or promote third-party products or services in chat or social interactions.

• Manipulate, exploit, or misuse social features—including gifting, referrals, helping, stealing, protecting, or visiting—for fraudulent or unfair purposes.

10. USER CONTENT AND MODERATION

You may be able to submit or generate content through the Services, including chat messages, emojis, usernames, garden layouts, social actions, and other in-game communications ("User Content"). You are solely responsible for your User Content.

Bountiful may, but is not obligated to, monitor, review, moderate, filter, or remove any User Content at any time to enforce these Terms or protect the safety and experience of players. Bountiful is not responsible for the conduct or content of other users.

11. INTELLECTUAL PROPERTY RIGHTS

We and our licensors exclusively own all right, title, and interest in and to the Services, including all associated intellectual property rights. You acknowledge that the Services are protected by copyright, trademark, and other laws of the United States of America, the Philippines, and other countries. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services.

Nothing in this Section limits the license you grant us to use User Content under Section 10.

12. TERMINATION

We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you, including if you breach these Terms. Upon any termination, discontinuation, or cancellation of Services or your account, all provisions of these Terms that by their nature should survive will survive.

13. WARRANTY DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Bountiful is not responsible for any User Content or for the actions, conduct, or communications of other players while using the Services

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER WE NOR OUR AFFILIATES OR LICENSORS WILL BE LIABLE IN ANY WAY FOR ANY LOSS OF PROFITS, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, OR THE DELAY OR INABILITY TO USE OR LACK OF FUNCTIONALITY OF THE SERVICES, EVEN IN THE EVENT OF OUR FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR BREACH OF OUR WARRANTY. WITHOUT LIMITING THE FOREGOING, YOU AGREE THAT BOUNTIFUL SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO PLAYER INTERACTIONS, IN-GAME COMMUNICATIONS, CHAT MESSAGES, SOCIAL FEATURES, OR USER CONTENT.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any action related thereto will be governed by the laws of the state of California without regard to its conflict of laws provisions. Any dispute arising from these Terms or your use of the Services shall be resolved in arbitration administered by JAMS in San Francisco, California pursuant to its Comprehensive Rules and Procedures. If the claim is not arbitrable, it shall be heard in the Superior Court of California, County of Santa Clara, or the United States District Court in the Northern District of California.

16. GENERAL PROVISIONS

These Terms, together with the Privacy Policy, constitute the entire and exclusive understanding and agreement between us and you regarding the Services. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

Certain features of the Services, including chat and social interactions, may be restricted or disabled for users who are under the age specified in our Privacy Policy or where required by law or platform rules. Parents and legal guardians are responsible for supervising minors' use of the Services.
